The Contract

When you place an order with The Company you are making an offer to buy goods.  We must receive payment in full before we can accept your order.  Once we have checked availability of the goods we shall contact you to confirm that we have accepted your order.  Our acceptance of your order brings into existence a legally binding contract between us.  In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this.  There will be no acceptance of your order, and there will be no contract between us.

Prices and Payment

The prices payable for goods are as set out on our website, and are inclusive of VAT at the current rate (currently 17.5%).  Delivery will be charged in addition, and will be shown on the FAQ page, and also in the shopping cart.  The charges are only valid for mainland Britain, and you may be required to pay extra for other locations.  This will be confirmed before payment is taken.  We accept all major credit and debit cards, with the exception of American Express.

Delivery

After we have checked availability of the goods we shall contact you to arrange a mutually agreeable delivery day.  Any dates are given in good faith but are targets only.  Time for delivery shall not be of the essence of the contract.  Whilst we endeavour to achieve any stated date we shall not be liable for any loss or damage whatsoever resulting from any such delay.

Delivery will take place to the address specified when you place your order.  It is important that this address is accurate, and it is your responsibility to check it.  We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions.  You will become the owner of the goods when they have been delivered to you.  Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver.

If the goods become lost in transit please let us know the next working day so that we can make a claim against the carriers.

If you do not accept delivery of the goods for any reason we reserve the right to pass on any costs which we may incur as a result of this.

Claims for damages/defects/shortages

The goods are to be checked for damages and accuracy before signing the delivery document.  It is not acceptable to sign as 'unchecked'.  If any damages or discrepancies are found then the Company must be informed, in writing, within 2 working days of the date of delivery.

The tiles should be inspected for suitability prior to fixing.  No claims will be accepted after the tiles have been fixed.

Cancellation and Returns

Once an order has been accepted by us you are unable to cancel it, except where granted by statute.  Details will be provided if applicable.  If you have a legal right to cancel the contract you must send the goods back to us, at our contact address, at your own cost and risk as soon as possible.

We are also unable to accept any goods back for refund unless the goods have been incorrectly supplied.

Shading

It is an inherent characteristic of ceramic tiles that some variation in shade can occur between batches.  Before fixing tiles, several boxes should be opened to ensure an acceptable blend.

Legal

All contracts shall be governed by and construed in accordance with English law, and parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.

If any part of these terms and conditions is held to be unreasonable, void or unenforceable, the enforceability of any other part of these conditions will not be affected.

Privacy Policy

Any personal information that you provide to us shall be used for the purpose of processing your order.  We shall not release any of this information to third parties, with the exception of facilitating delivery of the goods.
